The Supreme Court has rejected an objection aimed at disqualifying Acting Chief Justice Paul Baffoe-Bonnie from the panel adjudicating an injunction concerning the suspension of Chief Justice Gertrude Sackey Torkornoo.
In a unanimous ruling, a five-member panel determined that the objection lacked substance.
The request for recusal was submitted by former Attorney General Godfred Yeboah Dame, who represents the applicant. He contended that Justice Baffoe-Bonnie had a vested interest in the injunction application, arguing that its outcome could impact his role as Acting Chief Justice. However, the court ruled that the position of Acting Chief Justice, as established under Article 144 (6) of the Constitution, does not confer any personal interest upon the individual holding that office.
“The objection is without merit and is therefore overruled,” the court stated.
